Public Information Requests (Open Records)

  • The La Vernia Independent School District will work proactively with members of the public to provide timely and accurate information according to the following guidelines and procedures set forth by the Office of the Attorney General of Texas.

    The Texas Public Information Act (Chapter 552 of the Texas Government Code; hereafter, The Act) gives the public the right to request access to government records. All government information is presumed to be available to the public. Certain exceptions may apply to the disclosure of the information.

    According to The Act, all public information requests must be submitted to a governmental body in writing. The request must ask for records or information already in existence. The Act does not require a governmental body to generate new information, conduct legal or other forms of research, or to answer questions or explain decisions. However, The Act does require a governmental body to promptly release requested information that is not confidential by law, either constitutional, statutory, or by judicial decision, or information for which an exception to disclosure has not been sought.

    A person may ask to review information, receive copies of information, or both. According to The Act, the governmental body may charge the requestor for copies produced to comply with a request for information. Under certain limited circumstances, a governmental body may also impose a charge for facilitating a review of information. All charges imposed by a governmental body for access to information must comply with rules set by the Texas Attorney General, unless another statute authorizes the governmental body to set its own charges.

    The requestor may complete and submit the following form provided by the District or submit other written documentation that states the requestor’s name, address, phone number, and a clear description of the information or documents requested.
