Public Information Requests (Open Records)
The La Vernia Independent School District will work proactively with members of the public to provide timely and accurate information according to the following guidelines and procedures set forth by the Office of the Attorney General of Texas.
TEXAS PUBLIC INFORMATION ACT
The Texas Public Information Act (Chapter 552 of the Texas Government Code; hereafter, The Act) gives the public the right to request access to government records. All government information is presumed to be available to the public. Certain exceptions may apply to the disclosure of the information.
According to The Act, all public information requests must be submitted to a governmental body in writing. The request must ask for records or information already in existence. The Act does not require a governmental body to generate new information, conduct legal or other forms of research, or to answer questions or explain decisions. However, The Act does require a governmental body to promptly release requested information that is not confidential by law, either constitutional, statutory, or by judicial decision, or information for which an exception to disclosure has not been sought.
CHARGES TO REQUESTING PARTIES
A person may ask to review information, receive copies of information, or both. According to The Act, the governmental body may charge the requestor for copies produced to comply with a request for information. Under certain limited circumstances, a governmental body may also impose a charge for facilitating a review of information. All charges imposed by a governmental body for access to information must comply with rules set by the Texas Attorney General, unless another statute authorizes the governmental body to set its own charges.
During the 86th Legislative Session, the Texas Government Code was amended in a manner that allows Districts to designate a single electronic mail address and a single mailing address for receiving written requests for public information.
Effective September 1, 2019, requests for information from La Vernia ISD must be filed via one of the following methods:
1. By mail or in person at:
- La Vernia ISD, Attn: Public Information Officer, 13600 US Hwy 87 West, La Vernia, TX 78121
2. By email to: email@example.com with Public Information Request in the subject line and a specified return email address.
Please be advised that in accordance with the Texas Government Code, the District will only respond to requests for information sent to the email and mailing addresses designated above.
PUBLIC INFORMATION REQUEST FORM
Included in the updates to open government procedures made during the 86th Legislative Session was a provision requiring the Texas Attorney General to create a new public information request form that allows a requestor to specify that the District can exclude information it has determined to be confidential or subject to an existing exception to disclosure.
La Vernia ISD advises requestors to use this form for all information requests sent to LVISD. A copy of the form can be downloaded by clicking the link below:
